Why no videos?
This is an English translation provided for convenience. In the event of any discrepancy, the French version prevails.
To respect the rights of artists and producers, MyCritik does not host videos of shows. Share your best photos instead!
But they are everywhere on YouTube, TikTok and Instagram…
That is true, and it is no accident. These platforms have signed licensing agreements with collective rights management organisations (such as SACEM in France) and with record labels. They also have automatic content recognition tools (Content ID, Rights Manager), and Article 17 of the 2019 EU Copyright Directive requires them to act in this way.
On top of that, artists often tolerate these videos because they promote their work.
What about a small platform?
MyCritik has neither these licences nor these tools. A concert video contains a work (the song, the play), a performance (that of the artists) and often a staging: all of which are protected by copyright and related rights. We would remain protected by our status as a hosting provider, but we would have to remove every video reported to us, which means a heavy moderation cost and a legal risk, on top of the cost of storage and bandwidth.
And photos?
A photo taken from the audience to illustrate a review raises far fewer difficulties. Please still think of other audience members: avoid posting a photo in which someone can be identified without their consent (image rights).
And in the future?
The question may be reopened, for example through partnerships with venues or producers who hold the rights.
